The petitioner complains of non-compliance of the order passed in CWJC No. 1159 of 2014 whereunder this Court taking note of the grievance raised by the petitioner had disposed of the writ petition with liberty to the petitioner to file an application under the provisions of the Bihar Public Encroachment Act after impleading the land encroachers and also demonstrating the extent

Patna High Court MJC No.1523 of 2016 (2) dt.22-06-2016 of encroachment made by them. The counsel for the petitioner relies upon a representation filed present at Annexure-2 to maintain the contempt application.

In my opinion, it is the petitioner who is in contempt for he has failed to abide by the direction. No cause for indulgence is made out.

The application is dismissed.
