JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. Petitioner is accused in Triveniganj P.S. Case No. 277 of 2016 for the offence under sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. From perusal of the FIR, it appears that petitioner is a member of the unlawful assembly. There is no allegation of any overt act against him. There is specific allegation against one Abhimanyu Yadav that he fired and brother of the informant succumbed to firearm injury.

Considering the fact that there is no specific overt act against the petitioner and the petitioner is in custody since 14.12.2016, let the petitioner, named above, be released on bail on
