JUSTICE SHIVAJI PANDEY ORAL ORDER 08-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking bail in connection with Alamganj P.S. Case No. 948 of 2019 registered for offences under sections 25(1-b)a/26 of the Arms Act and 30(a) of the Bihar Prohibition and Excise Act. As per allegation made in the F.I.R., the police, on receipt of secret information, arrested the petitioner and recovered a pistol along with live cartridge as well as tetra pack containing English wine from him.

The petitioner is in jail custody since 20.12.2019 having no criminal antecedent.

Case No. 948 of 2019, subject to the condition that if the petitioner is found involved in future in similar type of offenses, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail granted to the petitioner.
