The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

It is alleged that on 22.03.2015 the minor daughter of the informant went to market from where she became traceless the suspicion was raised against the petitioner that the petitioner kidnapped her. In 164 Cr. P.C. statement, the victim got her aged recorded as 15 years wherein she has stated that she was kidnapped by this petitioner and was kept confined for 16 to 17 days.

It is submitted by learned counsel for petitioner that as per the matriculation certificate of the victim she was major

Patna High Court Cr.Misc. No.22518 of 2015 (2) dt.22-05-2015 2/2 on the date of occurrence and she claims to have returned from the place of confinement of her own which reflects that it was a simple case of elopement.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Muzaffarpur Town P.S. Case No. 210 of 2015, pending before the learned Chief Judicial Magistrate, Muzaffarpur.

With the above observation, this application is, accordingly, disposed off.
