This is an application for bail in connection with Ishachak P.S. Case No. 174 of 2016 registered for the offences punishable under Sections 366A/34 of the Indian Penal Code. Allegation against the petitioner and one more accused person is of kidnapping minor daughter of the informant. Submission of learned counsel for the petitioner is that statement of victim girl recorded under Section 164 Cr.P.C. shows that it is the co-accused who has committed some wrong upon her and allegation against the petitioner is of assisting the co-accused and he is in custody for six months.
Heard learned APP also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.38569 of 2017 (3) dt.25-08-2017 2/2 Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail after framing of charge in this case.
