2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Pakaribarawan P.S. Case No. 518 of 2024 registered for the offence under Sections 109, 118(2), 127, 191(3) of B.N.S. and 25 (1-b)a, 27, 35 of Arms Act.

3. According to the case of prosecution, On 23.11.2024, it is alleged that present applicant and other ten accused persons holding arms reached the spot then the dispute was taken place between informant and accused persons, due to that allegedly present applicant along with co-accused person fired on Bablu Singh, Gopal Kumar, and Mithu Kumar, due to

Patna High Court CR. MISC. No.15463 of 2025(3) dt.12-05-2025 2/3 that, Gopal Kumar sustained gun injury. On the basis of report made by the informant, offence has been registered and applicant has been arrested on 07.12.2024.

4. It is submitted by the learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case. The injury sustained by Gopal Kumar has been caused by co-accused Golu Kumar. He further submitted that from the present applicant no weapon has been seized. He is in custody since 07.12.2024. Charge-sheet has been filed. Trial is still going on, it will take some more time. He has no any criminal antecedent, therefore, on these grounds, it is prayed that he may be granted benefit of bail.

5. Learned counsel for the State as well as learned counsel for the informant opposed the arguments raised by the counsel for the petitioner.

6. Considering the above submissions made by the learned counsels and particularly considering the fact that no weapon has been recovered from the present applicant, I am of the view that the petitioner should be enlarged on bail.

7. Accordingly, the application is allowed.

8. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
