JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. At the outset, it is pointed out that the petitioner No. 1 namely, Kamal Kishore Prasad who happens to be husband of the deceased, has already been arrested by the police. It is further contended by him that so far as the petitioner No. 2 is concerned; she happens to be mother-in-law of the deceased and resides separately from the husband of the deceased, which is evident from perusal of Annexure-3 to the petition.
Considering the aforesaid submissions as well as facts and circumstances of the case, the prayer for anticipatory bail of the petitioner No. 1 namely, Kamal Kishore Prasad stands
Patna High Court Cr.Misc. No.22871 of 2015 (2) dt.09-07-2015 2/2 dismissed being infructuous and the petitioner No. 2 namely, Shyampari Devi, in the event of her arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Paraiya P.S. Case No. 30 of 2015 to the satisfaction of Chief Judicial Magistrate, Gaya subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
