The petitioner apprehends his arrest in connection with Dhamdaha P.S. Case No.325 of 2022 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. The petitioner has no concern with the alleged seized vehicle or liquor.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

Patna High Court CR. MISC. No.17838 of 2023(3) dt.15-05-2023 2/2 parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Judge, Court No.2, Purnea in connection with Dhamdaha P.S. Case No.325 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
