JUSTICE ANIL KUMAR SINHA ORAL ORDER 30-05-2023 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State. This application, for grant of anticipatory bail, arises out of Warsaliganj Police Station Case No. 652 of 2022, dated 31.10.2022, disclosing offences punishable under Sections 354B/504/506/34 of the Indian Penal Code. The prosecution case, as per the First Information Report, is that while the daughter of the informant was returning home from the market, the petitioner pulled her saree with an intention to outrage her modesty.
Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of concocted story. He further submits that though the daughter of the informant is a married lady, having one child, aged about 28 years, has not lodged the present First Information Report, but

He further submits that both the parties are co-villagers and there is dispute between the family of the petitioner and the daughter of the informant. Regards being had to the submissions advanced on behalf of petitioner and taking into consideration the nature of allegation and the fact that both the parties are co-villagers, having previous dispute between the two family, I am inclined to grant the petitioner privilege of anticipatory bail. This application is, accordingly, allowed.
Let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, Nawada, in connection with Warsaliganj Police Station Case No. 652 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
