JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 03-10-2016 After some argument, the learned counsel appearing on behalf of the petitioner, in presence of the learned State counsel appearing on behalf of the respondent Nos. 1 to 3, seeks permission to withdraw the present writ petition with a liberty to raise all the issues of facts and law, which have been raised in the present writ petition, in Mutation Appeal No.9 of 2003-04, if it is still pending before the respondent D.C.L.R., Purnia. Permission is accorded.
The writ petition stands dismissed as withdrawn with the
Patna High Court CWJC No.12629 of 2014 (2) dt.03-10-2016 2/2 liberty aforesaid.
However, if the aforesaid Mutation Appeal No. 9 of 2003-04 has finally been disposed of during the pendency of the present writ petition, and the petitioner feels aggrieved by the appellate order, then the petitioner shall be at liberty to challenge that appellate order before the prescribed revisional authority, which shall be decided strictly in accordance with law. It is further clarified that if the petitioner applies for certified copy of any public document, then that must be supplied to him by the concerned authority without any unnecessary delay.
