Heard the parties in virtual Court.
Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 363, 366, 307, 504, 506, 34 of the Indian Penal Code.
Allegation of kidnapping and commission of rape is against others as disclosed in the statement of the victim recorded under Section 164 Cr.P.C. Petitioner is not named in that statement. The allegation against the petitioner is of commission of assault in a subsequent occurrence. Having similar allegation, co-accused-Harendra Prasad has already been allowed anticipatory bail by a Coordinate Bench of this Court vide order at Annexure-4.
Considering the fact that there is no direct material against the petitioner and investigation of the case is already
Patna High Court CR. MISC. No.26745 of 2021(2) dt.21-09-2021 2/2 complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kesariya Police Station Case No.310 of 2019 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
