This application for grant of anticipatory bail arises out of Manjhi P.S. Case No. 02 of 2016, disclosing offences under Sections 341,323,324,307,379,504/34 of the Indian Penal Code. Learned counsel appears to be right in his submission that some quarrel between the children of the two families could be the reason behind the occurrence. It is his submission that fardbeyan of the informant is an exaggerated version of the two occurrence. Learned counsel appearing on behalf of the informant has opposed the prayer for bail and has submitted that there is specific allegation against this petitioner of assaulting with Daab on the head of the informant.

Be that as it may, considering the genesis of the occurrence

and in the facts and circumstances of the case, this application is allowed. Let the petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. (V), Saran at Chapra in Manjhi P.S. Case No. 02 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
