JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-07-2015 Learned counsel for the petitioners submitted that petitioner no. 6, Bhikhari Yadav, has already been arrested. Accordingly, the prayer for anticipatory bail of petitioner no. 6, Bhikhari Yadav, is dismissed as the same has become infructuous. Heard both sides.

The petitioner nos. 1, 2, 3, 4, 5 & 7, namely, Amin Yadav, Sudama Devi, Jai Narayan Yadav, Urmila Devi @ Lalsa Devi, Gamita Kumari and Tetari Devi, apprehend their arrest in a case under Section 366A and other sections of the Indian Penal Code.

Patna High Court Cr.Misc. No.23259 of 2015 (2) dt.08-07-2015 2/2 The daughter of the informant had gone to take tuition but she did not return. The relative of the informant disclosed that the victim was seen going along with Jiyut Yadav, son of Amin Yadav (petitioner no. 1). It is alleged that when the informant went to enquire, the petitioners assaulted the informant. Considering the facts aforesaid and the fact that there is no allegation of kidnapping against the petitioners, the above named petitioner nos. 1, 2, 3, 4, 5 & 7, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Turkauliya (Banjariya) P.S. Case No. 277/2015, corresponding to G.R. No. 1586/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
