The petitioners apprehend their arrest in Feshar P.S. Case No. 98 of 2021, registered for the offences punishable under Sections 307, 323 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.
As per the prosecution case, all the FIR named accused persons including petitioners assaulted the informant
Patna High Court CR. MISC. No.16171 of 2022(2) dt.25-08-2022 2/2 and his family members, as a result of which three persons sustained injuries.
It is submitted that specific accusation of assault is against other co-accused persons. The doctor has found the injury to be simple in nature. Petitioners are close relative of informant and they have been falsely implicated in this case due to family dispute. There is case and counter case. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Aurangabad in connection with Feshar P.S. Case No. 98 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
