In this application for anticipatory bail the petitioner apprehends his arrest in a case punishable for the offence under section 302 of the I.P.C. and section 27 of the Arms Act. It is submitted that the petitioner is not named in the F.I.R. and after consultation the informant has stated his name only on suspicion. There is no eye witness and in this case similarly situated co-accused Lachhman Mishra and Malak Kunwar has been allowed pre-arrest bail vide order dated 14.01.2015 in Cr. Misc. No. 30729 of 2014. The petitioner has got no criminal antecedent.

The learned A.P.P. duly assisted by the counsel for the informant opposes the prayer for pre-arrest bail of the petitioner. In the facts and circumstances as stated above,

No.29170 of 2014 (3) dt.21-01-2015 2/2 considering the case of the petitioner also similar to those coaccused who have been allowed pre-arrest bail the petitioner is also directed to be released on bail in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Munger in Muffasil P.S. Case No. 45 of 2014, subject to the conditions as laid down in section 438 (2) Cr.P.C.
