The petitioner is accused in connection with Saharsa (Sadar) P.S. Case No. 15 of 2015 registered under Sections 394 and 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that on the basis of written report of informant, Bhuban Kishore Gupta, father of the deceased, F.I.R. was lodged against unknown. The name of petitioner has been disclosed by the spy, which would appear from paragraph 22 of the case diary, and the petitioner has remanded on 12.01.2015 but till today he has not been put on T.I. Patna High Court Cr.Misc. No.23489 of 2015 (3) dt.01-10-2015 accused, Ganga Prasad Yadav @ Ganga Yadav, has already been granted privilege of bail by this Court vide order dated 27.08.2015 passed in Criminal Misc. No. 36015 of 2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Saharsa (Sadar) P.S. Case No. 15 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
