The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 504, 323, 120B of the Indian Penal Code. The prosecution case is that the informant and accused no. 1 Uday Shankar were business partner in a contract for water storage tower. The complainant made the investment in the partnership firm consisting the complainant and Raju Singh, subsequently, the accused persons took away the agreement paper, but due to non completion of the scheme Rs.

25,00,000/- were misappropriated by the accused persons.

It is submitted by the learned counsel for the petitioner that admittedly the contract agreement was

Patna High Court Cr.Misc. No.16586 of 2016 (2) dt.18-04-2016 between the informant and Raju Singh and considering the accusation arising out of contractual nature of dispute, the co-accused Uday Shankar has been granted bail by a Coordinate Bench of this Court vide Cr. Misc. No. 11193 of 2016.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Rajendra Das, J.M., Ist Class, Lakhisarai in connection with Halsi P.S. Case No. 127 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
