Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Khodawandpur (Chhaurahi O.P.) P.S. Case No. 44 of 2022 dated 19.02.2022 registered for the offences punishable under sections 341, 342, 385, 386, 504, 506 read with section 34 of the Indian Penal Code and under section 67A of Information Technology Act 2000.

As per the prosecution case, the petitioner and the coaccused persons are alleged to have taken Rs. 50,000/- and Rs. 1,50,000/- from the informant and also uploaded the photographs of

Patna High Court CR. MISC. No.16651 of 2023(2) dt.11-05-2023 2/2 the daughter of the informant on Whatsapp and Facebook and made them viral with dirty messages. They also threatened the informant to transfer the property in their favour.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Similarly situated co-accused persons have already been granted bail by the co-ordinate bench vide order dated 24.11.2022 passed in Cr. Misc. No. 25732 of 2022 with Cr. Misc. No. 29583 of 2022. The petitioner is also accused in one more criminal case as stated in para 3 of the bail petition. The petitioner is in custody since 02.01.2023. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Manjhaul, Begusarai in connection with Khodawandpur (Chhaurahi O.P.) P.S. Case No. 44 of 2022.

The application stands allowed.
