2. The petitioner seeks bail in a case registered for the offence punishable under Sections-21(b)/22(b)/25/29 of NDPS Act.
3. It is alleged that on the tip off, the informant along with police personnel reached at the place of occurrence and 29 bottles of Escof (Codeine Phosphate and Triploridine Hydrochloride Syrup) containing 100 ml. each, SpasmoProxyvon Plus Capsules IP-220 Nos. drugs were recovered under the seat of the Motorcycle bearing Registration No. BR50R-0436 belonging to the petitioner.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.17553 of 2025(3) dt.13-05-2025 2/2 that the petitioner is innocent and he has falsely been implicated in this case. The quantity of Codin which is psychotropic material, the basic ingrerdient of the cough syrup, is 5.8 gram which is a small quantity. So far as Spasmo-Proxyvon tablets is concerned, it is a pain killer. It has further been submitted that in paragraph-7 of the counter affidavit, the weight of psychotropic substance has been mentioned as 5.8 grams, which is the small quantity. The petitioner is a person of clean antecedent. The petitioner is a person of clean antecedent and he is in custody since 31-07-2024.
5. Mr. Shailendra Kumar, learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, specially the clean antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Supaul in connection with Birpur P.S.
