Petitioner seeks bail in connection Sahebganj P.S. Case no. 205 of 2017 registered for the offence punishable under sections 302, 120B/34 of the Indian Penal Code read with sections 25(I-b)a, 26 and 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is in custody since 25.09.2020 and charge sheet has been submitted. Learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that his father was engaged in door step delivery of SFC godown and his mother is Mukhiya of Grampanchayat, Gulabpatti. Further on 14.07.2017 at 10.40 while his father was returning home from the said godown after making payment to drivers of vehicles for diesel and when he reached in the way of

Learned counsel next submits that FIR was against unknown and during course of investigation one Bikesh Kumar Singh was arrested and said Bikesh Kumar Singh disclosed the name of this petitioner in his confessional statement. He submits that said Bikesh Kumar Singh has been granted bail by the learned court below. Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 25.09.

2020, charge sheet has been submitted and co-accused Bikesh Kumar Singh has been granted bail, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate I, Muzaffarpur in Sahebganj P.S. Case no. 205 of 2017 with condition that one of the bailers would be his father and he would watch the activity of the petitioner.
