JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.

It is alleged that11/2 katha land was purchased by the husband of the informant from one Jhunnu Mian, the brother of the petitioner and assured that the petitioner will transferred the rest of the land subsequelty when the request was made for executing the sale deed with regard to rest of the land then the petitoner made assault and gave life threat to the husband of the informant on 14.07.2014 the husband of the informant left the house for milking the cow of Suresh Paswan but on 15.07.2014, the dead body of the husband of the informant was recovered hence suspicion, was raised against the petitioner.

No.23098 of 2015 (2) dt.13-07-2015 2/2 It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled and the informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Sakra P.S. Case No. 65 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
