JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-06-2020 The petitioner, who is in custody since 10.01.2020, seeks bail in connection with Sonbarsa Raj P. S. Case No. 6 of 2020 dated 09.01.2020 instituted for the offences under Sections 356 and 379 of the Indian Penal Code and Sections 25(1-b)a and 26 of the Arms Act, 1959.

The petitioner along with two other accused persons waylaid the driver of the informant and one of the associates of the petitioner decamped with Rs. 45,000/- after snatching it from the driver of the informant. The petitioner and one of his associates were

Patna High Court CR. MISC. No.16517 of 2020(2) dt.01-06-2020 2/2 apprehended / arrested. A country-made pistol also was recovered from the petitioner.

It has been urged on behalf of the petitioner that he has been arrested on suspicion and mistaken identity.

Regard being had to the nature of accusation, the period of custody and his being a person of clean antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Saharsa in connection with Sonbarsa Raj P. S. Case No. 6 of 2020.
