The petitioner is apprehending arrest in a case registered for the offences punishable under Section189/420/409/467/468/471 of the Indian Penal Code. It is alleged that during an enquiry with regard to misappropriation of fund with regard to scheme of bamboo plantation under 'MANREGA' scheme, it was found that Jai Ram Pathak the then Panchayat Sewak, failed to submit the records before the Deputy Development Commissioner, hence, the present FIR was registered against him. The petitioner was not named in the FIR but name of the petitioner sprang up during investigation.

It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.15026 of 2015 (2) dt.12-05-2015 2/2 that after full-fledged enquiry nothing transpired against the petitioner and subsequently during investigation the petitioner's name sprang up.

Considering the fact that nothing transpired against the petitioner during internal enquiry and the petitioner being a lady, let her be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Gaunaha P.S. Case No.20 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
