====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 188, 290, 272 of the Indian Penal Code and Sections 30 (a), 37 (b) (d) of Bihar Excise Amendment Act, 2016.
It is contended that, as per allegation, 91 pouches of country made liquor (each containing 200 ml.), 6 bottles of foreign liquor (each containing 375 ml.) and 11 bottles of foreign liquor (each containing 180 ml.) were recovered from the house of the petitioner. It is claimed by the petitioner that she is not living in that house and in fact she has filed a case under Section 498 A of the Indian Penal Code against her husband. It is urged that the petitioner is in custody since 30.05.2017. It is claimed that her antecedent is clean.

No.34655 of 2017(2) dt.10-08-2017 2/2 Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV-cum-Special Judge, Excise Act, Bhagalpur in connection with Kahalgaon P.S. Case No.181/2017 with a condition that if the petitioner, after her release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of her bail bonds.
