2. The petitioner seek regular bail in Alipur P.S. Case No. 116 of 2025 dated 30-08-2025, registered under Sections 115(2), 126(2), 329(4), 74, 75(2) 64(1) & 351(3) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in short, is that in the night of 29.08.2025 at about 10:30 P.M., the petitioner entered the house of the informant through the roof, threatened her with a pistol and committed rape. When she raised alarm, her father-inlaw came, whereafter the petitioner fled away from the spot. 4.Learned counsel for the petitioner submits that the

It is further submitted that the victim/informant, in her statement recorded under Section 183 of the Bharatiya Nyaya Sanhita, 2023 before the learned Magistrate has supported the prosecution case. However, she also stated that previous disputes between the parties had been amicably settled. It is submitted that in the present case as well, the petitioner and the informant have filed a joint compromise petition dated 02.01.2026 before the concerned court stating that the informant does not wish to pursue the matter further. It is further submitted that earlier the informant had demanded money from the petitioner, pursuant to which, the petitioner transferred Rs. 5,000/- on 02.08.2024 and Rs.

10,000/- on 05.08.2024 through UPI to the informant's account in Bank of Baroda. Further submission is that the petitioner and the informant were acquainted with each other prior to the alleged occurrence and on account of some misunderstanding, the present case has been lodged. Lastly, it is submitted that the petitioner is in judicial custody since 01.09.2025 and has no criminal antecedents.

5. Learned counsel for the informant as well as the learned Additional Public Prosecutor for the State have not controverted the submissions advanced on behalf of the

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VI Gayaji, in connection with Alipur P.S. Case No. 116 of 2025.

7. The application stands allowed.
