JUSTICE MADHURESH PRASAD ORAL ORDER 25-02-2019 The writ petition has been filed for a direction upon the respondents to constitute fresh Medical Board for examination of the petitioner. Direction has been sought since the petitioner was declared medically unfit for the purpose of selection undertaken for appointment of Constable CT/GD in the CRPF.

Respondent Union of India has filed a counter affidavit after serving a copy on the petitioner's Counsel, way back in November 2016. It is specifically stated that on account of being declared medically unfit in the medical test in February

Patna High Court CWJC No.11832 of 2014(3) dt.25-02-2019 2/2 2014 unfitness letter was handed over to the petitioner on 26.2.2014 with a direction that he may prefer to file appeal against the findings of the medical examination in the prescribed format. The respondents have stated that no appeal for review medical examination was filed by the petitioner and, therefore, having failed to avail of opportunity he cannot claim any relief as prayed for in the instant writ petition. Since none appears for the petitioner, without going into merit of the submission made by Counsel for the Union of India, the writ petition is dismissed for want of prosecution.
