The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 467, 468 and 471 of the Indian Penal Code and sections 30(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 2673 litres of liquor is stated to have been recovered from a truck and the petitioner who is said to be the driver was taken into custody. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession or from the truck in question. He has been falsely implicated in the case. He is in custody since

Having heard learned counsel for the parties and taking into consideration the report received from the Senior Superintendent of Police which confirms that the petitioner has no criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Special Case no. 178 of 2021 (arising out of Bihta P.S. Case no.18 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna.
