Petitioner being mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The accusation is killing the sister of the informant after six years of marriage.
It is submitted by learned counsel for the petitioner that petitioner is separate from the husband of the victim and the accusation is omnibus and general. The impugned order reflects that charge-sheet has been submitted under Section 304(B)/34 of the Indian Penal Code against the petitioner.
Considering the fact that investigation has already concluded and petitioner is a lady, it is a case for
Patna High Court Cr.Misc. No.23697 of 2015 (2) dt.08-07-2015 2/2 consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Forbesganj P.S. Case No. 92 of 2014, pending in the Court of learned Chief Judicial Magistrate, Araria.
With the observations above, the application stands disposed off.
