Petitioner is accused in connection with Sare P.S.Case No.4 of 2015 for the offences punishable under Section 394, of the I.P.C.

Counsel for the petitioner submits that petitioner has no criminal antecedent as per the statement made in paragraph no.3 of the petition. He further submits that this case is registered against unknown and one Raja Kumar was granted anticipatory bail by this Court vide order dated 13.07.2015 passed in Cr.Misc. No.21768 of 2015 whereas Neeraj Kumar and Md. Abid have been granted regular bail in Cr.Misc. No.22220/16 on 28.09.2016 and Cr.Misc. No.45011/16 on 19.10.2016. It is stated that the case

Patna High Court Cr.Misc. No.44155 of 2017 (2) dt.19-09-2017 2/2 of the petitioner has neither been put on T.I.P.. In such situation, keeping the petitioner in custody will be abuse of the process of the court and petitioner is in custody since 26.07.2017, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Biharsharif, in Sare P.S. Case No.4/15 subject to the condition that the petitioner will cooperate in conclusion of the trial and will not tamper, in any manner, with evidence or influence the witnesses.
