JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as informant. Petitioner is apprehending arrest in connection with Muffasil P.S. Case No. 382 of 2019 arising out of G.R. Case No. 6280 of 2019 for the offence under sections 498(A), 323, 341/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that the petitioner is husband and he is ready to keep his wife, opposite party no.2 with full honour and dignity.

Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below

Patna High Court CR. MISC. No.14210 of 2020(2) dt.01-07-2020 2/2 within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, in connection with Muffasil P.S. Case No. 382 of 2019 arising out of G.R. No. 6280 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C.

The court below is directed to refer the matter to the Mediation Center for settlement of the dispute between the parties amicably for restoration of conjugal life. In the event, the petitioner neglects or misbehaves with the opposite party no.2, the court below shall be at liberty to cancel the bail bonds of the petitioner.
