20-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Town P.S. Case No. 397/2016 registered for the offence punishable under Sections 25(1-B) a, 26 and Section 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner was arrested on 29.08.2016 on the allegation that he was in possession of three live cartridges. The petitioner is, therefore, in custody for more than one year. He also submits that there was one case on the head of this petitioner as stated in paragraph-3 in which he is already on bail.

Patna High Court Cr.Misc. No.44659 of 2017 (2) dt.20-09-2017 Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Town P.S. Case No. 397/2016, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
