Petitioner seeks regular bail in a case registered for the offence punishable under Section 8, 20(b) (ii)(c), 25 and 29 of the NDPS Act.

As per the prosecution case, 1205 Kg of Ganja was recovered from the possession of the petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and recovery is made from a truck of which the petitioner is neither owner nor driver and rest of recovery is made from a house which is in joint possession of family. Petitioner is in custody since 31.05.2018. The charges have already been framed but till date not a single prosecution witness has been

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and huge quantity of recovery of Ganja from the possession of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

The trial court is directed to expedite the trial and conclude the same as early as possible.
