The petitioner seeks bail in Banka P.S. Case No. 515 of 2016 registered under Sections 395,307 & 412 of the Indian Penal Code.
As per the prosecution case, Rs.3,91,490.00 is said to have been looted from the Canara Bank by 4-5 unknown miscreants.
It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. Nothing incriminating article has been recovered from his conscious physical possession. He was not put on test identification parade. There is nothing on the record
Patna High Court Cr.Misc. No.38104 of 2017 (02) dt.10-08-2017 2/2 indicating the complicity of the petitioner in the occurrence barring the confessional statement of a co-accused. One similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No.1177 of 2017 vide order dated 15.02.2017. The petitioner has been languishing in custody since 27.02.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No.515 of 2016.
