2. The petitioner seeks bail in Ayer P.S. Case No. 20 of 2023 registered for the offence punishable under Sections341, 323, 307, 504 of the Indian Penal Code and 27 of the Arms Act.
3. As per allegation, when the informant demanded his dues amount, the petitioner fired at him. The bullet penetrating from the hand, entered into his chest.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted that there is no explanation as to why the informant did not go to the
Patna High Court CR. MISC. No.22259 of 2024(3) dt.04-07-2024 2/2 government hospital for treatment. He has also submitted that in all the criminal cases, pending against the petitioner, he has been granted bail.
5. On the other hand, learned counsel for the informant as well as the learned APP Mr. J. N. Thakur has opposed the prayer for bail and submitted that the petitioner is assailant. The injured informant supported the allegation in his statement recorded at paragraph-33 of the case diary. A number of criminal cases are pending against the petitioner.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and accordingly, the same is rejected.
