2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392 and 411 of the Indian Penal Code.

3. The case of the prosecution is that on the date of occurrence, informant has collected Rs. 67,710/- from the two centres and when he proceeded to third centre, two unknown miscreants followed him and snatched his bag containing Rs. 67,710/-. The case was registered against the unknown miscreants.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.15621 of 2025(2) dt.19-03-2025 2/2 present case. From the perusal of the order of the trial court, the name of the petitioner has surfaced in this case on the basis of confessional statement of apprehended co-accused Nitesh Singh. In his confessional statement it has come that the petitioner was a liner. It means that the petitioner is not amongst those persons who have snatched the bag of the informant. Petitioner has two criminal antecedents and in one case he is on bail. Moreover, the petitioner is languishing in judicial custody since 20.12.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Turkauliya Banjaria P.S. Case No. 638 of 2022, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari.
