The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307 and 448 of the Indian Penal Code. It is alleged that the accused persons including the petitioners entered into the house of the informant and assaulted the informant with 'garasa' when wife and daughter of the informant came to rescue they were also assaulted by co-accused Pillu Ram.

It is submitted by learned counsel for the petitioners that the accusation of assault is not specific against the petitioners and the informant has received only one injury which is

Patna High Court Cr.Misc. No.25841 of 2015 (2) dt.17-07-2015 2/2 superficial simple in nature. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the fact that accusation of assault is not specific against the petitioners being ladies having no criminal, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saharsa in connection with Basnahi P.S. Case No.49 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
