The petitioner apprehends his arrest in a case registered under sections 447, 341, 323, 324, 307, 504, 506 of the Indian Penal Code and 3(i)(x) of the SC/ST Act.

The prosecution story as per the fardbeyna of one Kismati Devi is that on 15.01.2014 while informant was sitting at her house Umesh Singh and Anil Singh who are accused in the murder case of her grand daughter came and asked the informant to withdraw the case of else she would be killed. Informant registered and refused to withdraw the case upon which she was abused in the name of her caste and an attempt was made through a sharp weapon to assault on her neck which she resisted by her hand causing injury on her finger, meanwhile her husband reached who also was beaten by the accused persons. Reasons for the assault were said to the case filed by informant's side.

Patna High Court Cr.Misc. No.24498 of 2015 (2) dt.14-07-2015 2/2 On behalf of the petitioner it is submitted that this case is counter blast of Mahanar P.S. Case No. 16 of 2013. It has further been submitted that as per the allegation petitioner is said to have caused injury on the finger of the informant which is non-vital part of the body. It is further submitted that petitioner has been falsely implicated in the present case due to previous enmity.

On behalf of the State it is submitted that petitioner is named in the first information report.

Considering the aforesaid fact, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Mahanar P.S. Case No. 7 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
