JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2017 The petitioner seeks regular bail in connection with Sakra P.S. Case No. 206 of 2016, registered for offences punishable under Sections 387 and 120B of Indian Penal Code and Section 17, 18, 19, 20, 21, & 23 of U.A.P. Act.
Allegation against the petitioner of demand of Rangdari. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R. his name transpired in this case only on the basis of confession statement of co-accused and further at the time of alleged occurrence, he was already in custody in connection with other case. In this case petitioner has been in judicial custody since 02.02.2017.
Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and
Patna High Court Cr.Misc. No.30751 of 2017 (4) dt.01-08-2017 circumstances of the case couple with the fact that petitioner has criminal antecedent as he his accused in twelve other cases and all of them are of serious nature, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial of the petitioner.
