JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 16-06-2020 Heard learned counsel appearing on behalf of the petitioner, learned counsel appearing on behalf of the State as well as learned counsel appearing on behalf of respondent-Patna Municipal Corporation.

The instant writ petition has been filed for a direction to the respondents to grant all retiral benefits with interest to the petitioner; dues of ACP and bonus of the year 1998; pay scale of the petitioner from the year 2012 and other post retiral dues. Considering the fact that the petitioner retired on 30.06.2017 as Sweeper from Patna Municipal Corporation, the writ petition is disposed of with a direction to the respondent-

Patna High Court CWJC No.10525 of 2019 dt.16-06-2020 2/2 Corporation to ensure payment of balance amount of post retiral dues including arrears of difference of salary and the benefit of ACP to the petitioner. Necessary decision in this regard shall be taken by the respondent-Corpration at the earliest preferably within a period of fifteen days from the date of receipt/ production of a copy of this order. In case there is delay in payment of pensionary benefits within the time indicated above, the entire amount will carry interest at the rate of 9.5% per annum from the date of filing of the writ petition i.e. 08.05.2019 till the date of actual payment which shall be borne out from the pocket of the respondent-Corporation.

With the aforesaid observation and direction, the present writ petition stands disposed of.
