JUSTICE SHIVAJI PANDEY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioners and learned counsel for the State through virtual court proceeding. In this case, the petitioners are seeking regular bail in connection with Sikraul P.S. Case No. 6 of 2020 registered for offence punishable under sections 379/ 511 IPC, later on, section 411 IPC has been added.
An FIR has been lodged against unknown for commission of theft of motor cycle. One Rahul Kumar has been arrested and on his confessional statement, the names of the petitioners have transpired, including the stolen motor cycle has also been recovered.
Patna High Court CR. MISC. No.14003 of 2020(2) dt.04-06-2020 2/2 Learned counsel for the petitioners submits that there is no criminal history of the petitioners and they have remained in jail custody for about six months and other co-accused, namely, Vicky Kumar, who is similarly situated person, has already been granted bail in Cr. Misc. No.14232 of 2020. Looking to the entire facts and circumstances of the case, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Sikraul P.S. Case No.6 of 2020, subject to the condition that one of the bailors of the petitioner shall be close relative. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. The petitioners will report to Sikraul P.S. Case No.6 of 2020 in the first week of every month at least for six months.
