JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 341, 323, 436 and 504 of the Indian Penal Code.
Allegation is that petitioner along with other co-accused set fire the house of the informant resulting food grains, ornaments and other properties were burnt to ashes. They also assaulted the villagers who came to extinguish the fire.
It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent. The matter has been compromised between the parties. The other co-accused has been granted bail vide Cr. Misc. no. 21270 of 2015. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing
Patna High Court Cr.Misc. No.24538 of 2015 (3) dt.16-09-2015 2 / 2 bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri R. K. Pandey, learned Judicial Magistrate, Ist Class, Gopalganj, in connection with Kateya P.S. Case no. 238 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
