JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
The prosecution case is that the informant's truck was robbed while being driven by the driver, Mithu Paswan, and cleaner, Pankaj Kumar Mandal. The name of petitioner sprang up in the confessional statement of co-accused Md. Arsad Ali and Md. Farooq.
It is submitted by the learned counsel for the petitioner that there is no recovery from the petitioner and the co-accused persons have named the petitioner maliciously. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court
Patna High Court Cr.Misc. No.18311 of 2016 (2) dt.28-04-2016 2/2 below in case the petitioners surrender within six weeks from today in connection with Dhoraiya P.S. case No. 182 of 2015 pending in the court of learned CJM, Banka This application is disposed of with the aforesaid observation/direction.
