Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner is in custody since 14.11.2019 and seeks bail in connection with Sessions Trial No.492 of 2019 arising out of Belsand P. S. Case No.143 of 2019 registered for the offences punishable under Sections 25(1-a), 26, 35 of the Arms Act.
One automatic pistol and three cartridges were recovered beneath the bed of petitioner and one co-accused. Admittedly, the petitioner was not caught on the spot nor
Patna High Court CR. MISC. No.20662 of 2020(2) dt.03-09-2020 2/2 anything was recovered from his conscious possession and Para3 of the petition goes to show that except one Belsand P. S. Case No.106 of 2019 registered under Section 302 of the I.P.C. and Section 27 Arms Act, there is no criminal antecedent of the petitioner.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Jyoti Prakash, learned Additional Sessions Judge-10th, Sitamarhi in connection with Sessions Trial No.492 of 2019 arising out of Belsand P.
