The petitioner seeks regular bail Sessions Trial No.1486 of 2013 arising out of Mahila P.S.Case No.13 of 2013 registered for the offence under Sections 376/34of the I.P.C. Learned counsel appearing for the petitioner submits that the prayer for bail of the petitioner has been refused thrice lastly on 24.01.2018 by this Court vide Cr.Misc. No.55713 of 2017 with direction to the trial court to conclude the trial within four months and if the trial is not concluded within the aforesaid period, the petitioner would be at liberty to renew his prayer for bail. Instead of passing over five months the trial has not been concluded and the witnesses are still to be examined.

Having considered the facts and circumstances of the

No.37396 of 2018 (2) dt.11-07-2018 2/2 case and the petitioner is in custody since 16.04.2013, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-10, Patna, in S.Tr.No.1486 of 2013 arising out of Mahila P.S.Case No.13 of 2013.
