====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 452, 341, 323, 354(A), 379, 504, 506/34 of the Indian Penal Code.

It is alleged that this petitioner entered the house of the informant and tried to disrobe her in order to outrage her modesty.

Learned counsel appearing for the petitioner submits that due to land dispute pending between the parties, this false and concocted case has been lodged against the petitioner. Both parties are gotiyas. Allegations under Sections 354(A) and 379 of the Indian Penal Code are super addition in order to make the case grave.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above

Patna High Court CR. MISC. No.16679 of 2023(2) dt.19-05-2023 2/2 named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Katoria P. S. Case No. 405 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
