The petitioners are languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of country-made liquor. The petitioners have got no criminal antecedent. They are in custody since 26.01.2021. Investigation of the case is already complete.

Considering the fact that this is the first allegation against the petitioners under Bihar Prohibition and Excise Act,

No.26845 of 2021(2) dt.24-09-2021 2/2 let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Excise Case No.31 of 2021, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
