KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner who is in custody seeks bail in connection with Bihta P.S. Case No. 267 of 2017 registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code read with Sections 25(1-B)a, 26/35 of Arms Act. The allegation against the petitioner is that one live cartridge was recovered from his possession. It has been further alleged that the petitioner and co-accused had assembled at the place of arrest for committing some grave offence and they were apprehended by the police on the spot.

Learned counsel for the petitioner submits that he is innocent and has got no criminal antecedent and is in custody since 25.04.2017.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.38822 of 2017 (2) dt.19-08-2017 the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Danapur, Patna, in connection with Bihta P.S. Case No. 267 of 2017.
