The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code and section 27 of the Arms Act to which sections 395 and 397 of the Indian Penal Code were added subsequently.

The prosecution case is of commission of robbery at the petrol pump by three unknown criminals.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against three unknown. The name of the petitioner transpired in the confessional statement of coaccused Satyam Kumar in course of investigation and the said

Patna High Court CR. MISC. No.26622 of 2021(4) dt.24-01-2022 2/2 Satyam Kumar has himself been enlarged on bail vide order dated 23.2.2021 (Annexure-3) passed in Cr. Misc. no.28070 of 2020. The petitioner is in custody since 28.8.2020 and chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year 4 months, the Court directs the petitioner to be enlarged on bail in connection with Dhaka P.S. Case no.492 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Dhaka, East Champaran.
