The petitioner has preferred this application for grant of regular bail in a case registered under sections 354(A), 354(B), 354(D) and 506 of the Indian Penal Code and subsequently, Sections 8 and 12 of POCSO Act is added. As per the prosecution case, the petitioner is said to have molested and sexually harassed the victim girl aged about 17 years while she was going to coaching. It is further alleged that the petitioner pulled her Duppata while she was returning

Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner is also accused in one more criminal case bearing Rampur P.S. Case No. 472 of 2019 registered under Sections 341, 427, 354(A), 504 and 506 of the IPC which was lodged by the informant. Learned counsel further submits that the allegation under Section 354(B) is not attributed against the petitioner and the rest bailable in nature. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Upadhyay, learned Special Judge, POCSO-cumA.D.J.-VI, Gaya, in connection with POCSO P.S. Case No.113 of 2021 arising out of Rampur P.S. Case No. 92 of 2020, with a condition that the petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be
