Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 379/34 and other allied sections of the Indian Penal Code.

Petitioners and other accused persons are alleged to have assaulted the informant with sticks and snatched money from his pocket.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Parties are gotia and there is land dispute

Patna High Court CR. MISC. No.15954 of 2022(3) dt.18-10-2022 2/2 between them. Injuries sustained by the injured have been found to be simple in nature. There is a case and counter case. Learned counsel appearing for the State as well as the informant oppose the prayer for bail. They submit that the informant sustained fracture injury in his leg. Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in Bheja Police Station Case No. 110 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
